At a special meeting held on August 11, the Otero County Commission also voted to sue the New Mexico Secretary of State, even though it was the New Mexico Supreme Court that ordered commissioners to do their legal duty and certify the 2022 primary election. The approximate cost of the lawsuit would be around $100,000, according to Otero County Attorney R. B. Nichols.

“Controversial Augustin Plains Ranch water project legal battles continue”

Last week the New Mexico Court of Appeals ruled that Augustin Plains Ranch LLC, which has applied to the state engineer to remove 54,000 acre feet of water annually from an aquifer in the southwestern part of the state and pipe it hundreds of miles away to Albuquerque area customers, should rightfully get another hearing on its application in district court.
