“Court rulings stacking up in U.S. nuclear storage fight”

Earlier this month, the federal appeals court in Louisiana upheld a lower court decision that the U.S. Nuclear Regulatory Commission did not have the authority to license a nuclear storage facility in Texas. Meanwhile, the federal appeals court in D.C. heard oral arguments regarding the license the NRC issued to Holtec International to store its high-level nuclear waste in southeastern New Mexico. The outcome of the New Mexico licensing case may be influenced by the Texas ruling, unless the latter is overturned by the U.S. Supreme Court.
