What you need to know, June 5, 2025: Texas v. New Mexico and Colorado

The long-running litigation Texas v. New Mexico and Colorado, which has cost us tens of millons of dollars may be coming to an end with a settlement between all the parties in the case.  Texas originally sued New Mexico claiming that its management of groundwater wells allowed drilling near the Rio Grande River which drew water reducing the flow of Texas water from Elephant Butte Reservoir where Texas water is stored.  The United States joined the litigation claiming that reduction of river water also affected its international obligations to Mexico.  Last year, Texas, New Mexico and their water users came to an agreement that settled their differences, but the United States objected to the settlement, and in June, the Supreme Court (in a 5/4 decision) upheld the argument of the United States and sent the case back into litigation.  Now, apparently, a joint agreement has been reached; though the terms of the agreement are not yet made public.  See the article in Source New Mexico:  https://sourcenm.com/2025/05/12/possible-settlement-reached-in-long-running-rio-grande-dispute/.
